Terms of Service

Thank you for choosing Rocket Hosting OÜ as your web hosting provider. By signing up for our services and completing the order form, you agree to be bound by the following terms of service ("TOS"). This agreement, along with our Acceptable Use Policy ("AUP"), constitutes a legal and binding agreement between Rocket Hosting OÜ ("Company") and the individual or business entity identified as the customer ("Customer"). From this point on, this agreement shall be referred to as the "Agreement" between the two parties.


1. INDEMNIFICATION POLICY

Rocket Hosting OÜ provides its services and facilities to you as is and without any warranty of merchantability or fitness for a particular purpose. In no event shall Rocket Hosting OÜ be liable for any loss, damage, or other commercial harm, including special, incidental, consequential, or other damages arising from the use of our services or facilities. You agree to defend, indemnify, and hold harmless Rocket Hosting OÜ, its agents, customers, officers, and employees from any and all claims, demands, liabilities, losses, costs, and expenses, including reasonable attorney's fees, arising from any service provided or performed, or product sold by you or your agents, employees, or assigns. You agree to indemnify Rocket Hosting OÜ against any liabilities arising from any injury to person or property caused by any product sold or otherwise distributed in connection with Rocket Hosting OÜ's server.

Rocket Hosting OÜ reserves the right to intervene in any website hosted on our servers to protect the interests of our customers. Any content supplied by you that infringes or allegedly infringes on the proprietary rights of a third party, including copyright infringement, or any defective products sold to you from Rocket Hosting OÜ's server, shall be considered a violation of our policies, and Rocket Hosting OÜ shall be the sole judge of what violates this Policy.

2. BILLING AND PAYMENT

We offer flexible billing periods for our server packages, which can be billed monthly, quarterly, semi-annually, or annually, depending on the package selected by the customer.

There are no contract periods for our services, but your contract and service renewal invoice will be generated automatically for each successive period unless you submit a cancellation request.

We send payment reminder emails to our clients periodically, with the following schedule:

Invoice Unpaid Reminder: Sent 5 days before the invoice due date.

First Overdue Reminder: Sent 1 day after the invoice due date.

Second Overdue Reminder: Sent 2 days after the invoice due date.

Third Overdue Reminder: Sent 3 days after the invoice due date.

However, it is the responsibility of the client to keep track of their renewal dates and renew their service on time. In the event that a payment reminder email is not delivered to the client due to technical errors, we will not be held responsible for any failure to renew the service on time. If a client fails to renew their service and their account is terminated, we will not be responsible for any data loss.

If a service is not paid within 3 days of the due date, it will be terminated on the 4th day when the daily cron job of the server runs. The exact time of termination may vary but is typically around 9 AM.

2.1 FRAUD VERIFICATION IN SOME CASES

In the event that we detect an order as fraudulent or suspicious, we may request that you make a manual payment to our PayPal account under the following conditions:

  • No physical delivery of goods or services is required.
  • We only accept payments from verified PayPal accounts.
  • The client details provided to us, including the email address, must match the PayPal account holder's information.

If the above conditions cannot be met, you must provide us with the following documents within 24 hours of receiving the request:

  • A valid ID proof (e.g. passport, license, or national ID) of the PayPal account holder.
  • A screenshot from your PayPal account showing full details of the transaction.
  • A photo of the card involved in the transaction (you may hide sensitive information such as the card expiry date and CVV).

You can submit these documents by creating a support ticket and attaching the documents or sending an email to info@rockethosting.org with your order/invoice details.

If you fail to provide the required documents within 24 hours, your order will be cancelled and your payment will be refunded.

Please note that we do not store these documents and will delete them immediately after your order has been verified.

2.2 LATE PAYMENTS AND LATE FEES

All accounts are billed based on the date they were first activated on. We generate all invoices 10 days before the due date.

If payment for your service is not received by your due date, your account will be suspended on the following day. If payment for service renewal is not received within 3 days after your due date, the system will assume that you are not interested in renewing your account and will terminate it on the 4th day. In such cases, all data will be deleted, and the server space will be re-used for another client. You will be responsible for any data loss resulting from the suspension or termination of your account as this is an automatic process performed by the system when services are unpaid.

Late fees of 10% will be charged if payment is overdue by 5 days, provided that the service has not been terminated and it is possible to renew it. If your account or order is terminated or cancelled, you will need to make a fresh order to continue using our services.

3. REFUND POLICY

We offer a refund policy for our services. To read our refund policy, please visit the "Refund Policy" section on our website.

4. ACCEPTABLE USAGE POLICY

To ensure that our services are used in a responsible and lawful manner, we have an acceptable usage policy in place. Please refer to the "Acceptable Usage Policy" section on our website to review our policy.

5. FAIR USAGE POLICY

All of our services with unmetered or unlimited bandwidth are subject to a fair usage policy.

5.1 DATA USAGE

We offer unmetered bandwidth on 1Gbps ports subject to our Fair Usage Policy (FUP). This means that while we do not place a limit on the amount of data you can use, we do expect you to use bandwidth responsibly and not overload our server resources.

Under our FUP, any streaming, CDN, or high port uplink using applications are not allowed on our 1Gbps unmetered ports. If your monthly bandwidth usage crosses 100TB or 300Mbps on the 95 percentile method, we may limit your port speed to 100Mbps until the end of the billing cycle unless you opt for a paid upgrade to our 1Gbps True Unmetered 24x7 option, which is available for an additional 29 Euros per month.

If we detect that your bandwidth usage is high, we may upgrade your bandwidth option from 1Gbps unmetered FUP (No Streaming) to 1Gbps True Unmetered 24x7 (streaming allowed). In such cases, you will be required to pay the upgrade fee for the current month and renew at the new pricing.

We regularly monitor our clients' bandwidth usage patterns, and any abusive usage of bandwidth will result in the immediate suspension of services. If we classify your usage as abuse, your services may be immediately suspended, and you may be denied the provision of any future services.

Please note that we strictly do not allow video/audio streaming or any other high bandwidth usage applications with 1Gbps unmetered FUP (No Streaming). For such high bandwidth usage applications, you must purchase a server with our 1Gbps True Unmetered 24x7 (streaming allowed) option.

Please also note that no refunds will be applicable in cases of a breach of our FUP.

5.2 PORT/UPLINK USAGE

All of our VPS host nodes have a dedicated uplink that is shared among multiple clients, typically between 10-12. Therefore, it is important to note that you may not always have access to the full speed of the uplink/port for yourself at all times.

5.3 FAIR USAGE OF SERVICES

All users are required to use the resources assigned to them in a fair manner that does not interfere with other users in the same environment. If Rocket Hosting OÜ determines that a user is abusing their assigned resources, we reserve the right to regain control of those resources without prior notice. In such cases, Rocket Hosting OÜ will not be liable or responsible for any losses incurred by the customer/user, and there will be no refund of any fees paid by the customer.

By using our services, all users agree not to interfere with other users in an unfair or malicious manner that may impact their ability to receive adequate services. Please note that the term "unlimited" used in reference to our services refers to an "unmetered" usage, and is subject to our Fair Usage Policy. Rocket Hosting OÜ reserves the right to impose restrictions of various sorts to ensure fair usage amongst the user community, without prior notice to existing or new users. In the event of repeated warnings, we may suspend and/or terminate offending users.

6. SERVICE SUSPENSION AND REACTIVATION

To ensure fair usage of our server resources, any client found to be abusing server resources or violating our Terms of Service (ToS) and Acceptable Use Policy (AUP) will be immediately suspended. A service re-activation fee ranging from €9 to €39 will be charged depending on the type of abuse and the number of previous suspensions for that client. Service reactivation charges must be paid before the account is re-activated. We reserve the right to deny any request for re-activation before/after payment of service reactivation charges to maintain server stability. In cases of repeated violations or severe abuse, we reserve the right to terminate a client's account without prior notice or permission. This includes but is not limited to instances of server abuse, multiple suspensions of a client's account due to breaches of ToS/AUP, and other such violations.

7. ABUSE PREVENTION POLICY

Rocket Hosting OÜ reserves the right to suspend or terminate the service of any client who engages in abusive or harassing behavior towards our employees. Examples of such behavior include, but are not limited to:

  • Verbal abuse, including cursing, yelling, or making threats
  • Disregard for warnings or notices
  • Consistent mistakes, errors, or changes causing unnecessary workload
  • Spamming our email addresses, ticket systems, or servers
  • Continuous involvement in flood/DDoS activity, hacked services, or other non-permitted usage
  • Consistent late payments or responses
  • Issuing a chargeback or bouncing a payment
  • Continuous activation of problematic end-users
  • Activity that negatively impacts the service(s) of other clients
  • Open disputes with payment gateways/banks without first discussing the issue with our Billing/Support team
  • Cancelling a current account and re-ordering a new account just to receive a new promotional discount/plan

Please note that Rocket Hosting OÜ takes such behavior very seriously and will not tolerate it. We reserve the right to suspend or terminate the service of any client engaging in such behavior without prior notice or refund.

7.1 DMCA / COPYRIGHT / REPORT ABUSE POLICY

Rocket Hosting OÜ does not entertain any DMCA notices or complaints as DMCA is not applicable under the laws of Netherlands.

In the event of a dispute over copyrighted content hosted on our infrastructure, parties may send us a copyright infringement complaint in accordance with applicable laws of Netherlands. However, we cannot act as an arbitrator in such cases and are unable to take down disputed content. We can only forward the complaint to the client. To remove any content or website from our infrastructure, we require an order from a court of law or concerned legal authorities.

To report any kind of abuse, please use our webform located HERE or send an email to abuse@rockethosting.org. We will forward the complaint to the concerned client.

8. BACKUPS and DATA LOSS

Your use of this service is at your sole risk. We do not provide any kind of backup system or service. You are responsible for taking your own backups manually. We are not liable for any files and/or data residing on your account. You agree to take full responsibility for files and data transferred, and to maintain all appropriate backups of files and data stored on our servers. We are not responsible for any kind of data loss caused by any reason.

9. PRICE CHANGE

The amount you pay for your service will remain the same for the current billing cycle from the date of purchase. However, prices may be subject to increase from the next billing cycle onwards. We reserve the right to change prices listed on our websites and to modify the amount of resources provided to plans at any time.

10. CHANGES TO THE TOS

Rocket Hosting OÜ reserves the right to revise its policies at any time without prior notice.

11. LIMITATION OF LIABILITY

Rocket Hosting OÜ shall not be held responsible for any damages, including incidental and consequential damages, arising from Rocket Hosting OÜ servers going offline or being unavailable for any reason whatsoever. Additionally, Rocket Hosting OÜ shall not be responsible for any damages, including incidental or consequential damages, resulting from the corruption or deletion of any website from one of Rocket Hosting OÜ servers. In any event, all damages shall be limited to the immediate termination of service.

12. DISCLAIMER

Rocket Hosting OÜ cannot be held liable for system downtime, crashes, or data loss. We also cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Rocket Hosting OÜ are resold. Thus, certain equipment, routing, software, and programming used by Rocket Hosting OÜ are not directly owned or written by Rocket Hosting OÜ. Moreover, Rocket Hosting OÜ holds no responsibility for the use of our clients' accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Rocket Hosting OÜ sees fit.

FURTHERMORE, Rocket Hosting OÜ retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

By purchasing any of our services, you agree to this Terms of Service (ToS) Agreement. If you do not agree to these services, please do not purchase any service or, if already purchased, immediately cancel it. No refund will be processed in such case.

Please note that by agreeing to these terms, you release Rocket Hosting OÜ from any and all claims, demands, and damages arising from or in connection with your use of our services. You also acknowledge that Rocket Hosting OÜ has no liability for any loss of data or other content, and that you are solely responsible for maintaining appropriate backups.
